To initiate the family mediation process, party A must schedule an intake appointment with the mediator. This initial consultation is essential to assess whether the matter is appropriate for mediation. During this individual appointment, you can discuss your concerns and what is currently happening.
If the matter is suitable for family mediation, the other party is formally invited into the process. Mediation is voluntary; however, if a participant decides not to participate after the intake appointment, a 60i certificate might be issued stating their non-attendance. This is one of the crucial mediation steps to ensure proper documentation.
If the other party wishes to participate in family mediation, an initial intake appointment with the mediator is scheduled. This individual appointment allows the other party to discuss their concerns and what is happening, as part of the mediation steps.
If the matter is deemed suitable for family mediation, the joint mediation session is booked following an initial intake appointment. During this session, the mediator will assist the parties in identifying the issues that need resolution and encourage each party to listen to the other’s perspective. The mediator will guide everyone through the mediation steps to ensure that the focus remains on the child/ren, aiming for an amicable resolution. Any agreements reached will be documented in a parenting plan.
